Supporting Lawyers to support Estate Agents
The new Trading Standards Material Information Guidance has extended the information Estate Agents need to obtain to be able to list a property.
This includes a significant amount of information which previously would have formed part of the conveyancing process, ranging from flying freeholds to restrictions.
Due to the complex nature of the new rules, many agents are looking for support from lawyers with compliance. This is recognised by Trading Standards. Their guidance states:
"Parts B and C material information may require where applicable, the engagement of a conveyancer"
The new rules provide a perfect opportunity for lawyers to collaborate more closely with estate agents, secure conveyancing instructions earlier and provide new services such as title fixes.

Instant Material Information

There are two stages to providing Material Information Services
- 1.Assembling the required documentation from sources such as HM Land Registry, and
- 2.Summarising this in a report format which agents can use as part of their listings.
The Home Owner's Passport web app has been designed to support lawyers in completing both these requirements quickly and efficiently, assembling the required up front information, and collating this into a Material Information Summary Report for agents.
What's in a Material Information Report?
The headline requirements contained in the Trading Standards Guidance can be found summarised in the 3 page Material Information Summary Report, saving significant fee earner time. It also includes the more specific property details which are required for full compliance, such as unavoidable property costs and leasehold information.
Conveyancing Onboarding
